            It isn't a question of who practices what. The question is where should the power to define appropriate social parameters exist? Who gets to say which behaviors are acceptable and which are not? If the people create anti-sodomy laws, and there is nothing in the constitution which says explicitely that they cannot, than the courts do not have a say on the issue. It belongs to the people. To make an argument that both represent different forms of oligarchy and are therefore equivalent is absurd. The court is an oligarchy, the people are not.

                          You're probably too young to remember. But a long time ago, but not so far away, there was a joke about a sheriff hunting a fugitive who had taken refuge in a chicken coop. The sheriff, thinking he heard movement in the coop called out, "Who is in there?" and the answer came back, "Nobody but us chickens, boss." No reference to courage or fowls were intended. (No harm, no fowls.)
