    I'm not a lawyer, but that seems to be an interesting defense strategy

    and one I may use from now on for everything

      The problem with this lawsuit is that Tesla Autopilot and FSD are demonstrably several times safer than the average accident rate in the US. (I'm listing the sources so you can make your own determination.) Tesla's internal report: [Tesla Vehicle Safety Report | Tesla](https://www.tesla.com/VehicleSafetyReport) In the charts, shorter bars are safer. IIHS's reports on EVs being generally safer: [With more electric vehicles comes more proof of safety](https://www.iihs.org/news/detail/with-more-electric-vehicles-comes-more-proof-of-safety)

        Safer? Absolutely, but he still regularly and constantly oversells it. It's far from, "A Tesla car next year will probably be 90 percent capable of autopilot." (with variations every year since 2014). If he pushed it as driver assist, there'd be no grounds for this case. As it stands, I'm surprised they didn't push for a class action.
