As I understood Joe's article, the laww passed by congress 8the one you quoted) is uncosntitutional itself, because Congress can declare war, but not pass on the power to do so to whoever. (I'm not a lawyer, but I sometimes have a beer with one)

the US doesn't declare war anymore. since the '40s, it's been one long string of military adventures without a formal declaration of war. while the constitutionality of this has been debated for the entire time, it's clear that nobody who's opinion matters disagrees that it's (at least) legal. -c
