Senate Bill 2611 increases High Tech Visas

You might have heard in the 'States about the protests on the House Bill. In response the Senate wrote a bill that increase the number of high tech workers H-1B Visas from 65,000 to 115,000 along with all the other legislation. Senate immigration bill raises H-1B limit[^] The IEEE was not too happy IEEE-USA President Ralph W. Wyndrum, Jr. said: "We don't understand why the Senate wants to expand a program that numerous government reports have found leaves U.S and foreign workers open to exploitation. Fraud, abuse and misuse of the visas is rampant. The program should be fixed before it is expanded."

Actually, the "foreign worker gets exploited" argument may be a little exaggerated. Most Indian friends I have, who are on H1Bs in the US, make well above 75K USD which may not be a super salary, but is not exploitation either. The lowest paid are people who are working on client-sites from companies like Infosys, Satyam etc. and even they have a minimum pay of 60K USD - they had to do that to avoid attrition. Because the H1B quota is limited, candidates have extra power to negotiate with their companies (Indian). A friend of mine got a hike out of his company by threatening to transfer his H1B to a consulting firm that promised him a higher pay. His parent company (Satyam) had to agree because they couldn't file an H1B for another candidate (with the required skills and project experience) till the quota reopened. Regards, Nish

When I moved from Canada to the USA, it was on a Trade Nafta visa. To start the permanent resident action, I had to switch first to and H1B visa. My employeers had to show that they had advertised for the position I held; since I was working for a consulting firm, the client also showed that they had been looking for someone to fill the position. In two years, I was the only applicant - period. There are some jobs, spefically 'older technology', that many people don't want to work with. There was someone in our office who quit and took a new job a year ago because she said, 'I don't want to work with that old stuff'. The program may be abused at times, but that doesn't mean it doesn't work at other times as well.

This bill will have to debated in House and fight with a similar yet different House bill. Comprehensive Immigration Reform (CIR) mainly focuses on 11+ million illegals and several backlogs (at different stages) of 350K to up a million legal immigrants. An ex colleague (who was a newbie) spent many hours trying to find out what was wrong with his program. Because of some unknown reason his IDE had stopped highlighting keywords and he got tons of compiling errors b/c of typing "thow" instead of "throw". This event entertained us for a long time. It's a good program, but the IEEE is right that they first need to fix several problems and enforce several of its provisions. Anyone who thinks he has a better idea of what's good for people than people do is a swine. - P.J. O'Rourke
