And what was the threat that she made?

Just a note from ALL your new neighbors in the new neighborhood. This is a white neighborhood and if you have to choose to live in a white neighborhood ACT white not like niggers. Keep your children contained in your house and not hanging out in the street like gangs. You really hurt the property value of the neighborhood. We so appreciate that.

Given Arkansas' history, which you are fortunate enough to be too young to have experienced, and the nature of the letter it is very obviously a threat. A hint, seeing as you seem to be having difficulties: the threat is not in calling them niggers--although her actions outside of the letter are certainly morally reprehensible. (For example, believing that 'the 12 year-old nigger son' would rape her daughter simply because some African Americans had comitted a rape nearby.) It is politically popular to jump on the hate crime "oh my god they are oppressing me again" wagon at the moment, especially as you seek to find argument in everything, but all your country's hate laws do is allow further sentencing for existing crimes. A hate crime was still a crime punishable by law before the term was ever written on paper. You need to be found guilty of the original crime before you can be sentenced further, it cannot be taken into account to decide a verdict. Hate crime is not a label added on me saying "I hate niggers", or parading round with it on a bill board. A hate crime would be me approaching a specific black person and saying "I hate you because you are black... so you'd better keep your kids indoors [or I might hurt them]". Threats can be implied. Ironically, and I'm sure you'll have all sorts of difficulties comprehending this, it was precisely the freedoms afforded to both parties in this specific case that caused the crime to be committed in the first place. As Rob has pointed out a few times to deaf ears, the fact that her legal representation advised her to plead guilty means that quite obviously she did break the laws, either of Arkansas or your federal laws. Case closed.

She made no threat. She made a statement about how they are depreciating the neighborhoods property value. Regardless if it is true or not, she did not say she would take action against them, she did not make a threat. She might have spooked them or angered them but she made no threat. I don't know how you define what a hate crime is but hate is an emotion, not a crime. What next?

I understood what you wrote, and you twisted what she wrote in the letter to make it sound threatening. If she don't like black people then so be it, I don't care. Its her personal feelings. That letter was foolish however it is not punishable. She should have got a warning stating she will not contact the naigbors she intimidated.

What is the threat she implied? Keep your children in the house because it depreciates the property value is like saying Do not post programming questions in the lounge.

Well if her neighbors were white and she were black then nothing would have came of it. Thats the way it seems to work these days.

I think there is a fine line between free speech and inciting fear/violence. If the free speech is directed on one person to incite fear then I think that is heinous--but I don't believe in hate crimes. A white family could do the same to another white resident based on religion, sex, sexual orientation etc. Intimidation is intimidation.

I think here in California it would be a violation of PC 422 - Terrorist Threat, which is a felony ( there has to be actual evidence of intent to cause a person bodily harm ).

She was stupid enough to use the U.S Mail to threaten them (hence charge # 1). She accused them of damaging property values just by their racial composition (hence charge #2). Just for her white trash stupidity she deserved to be charged. And to repeat: the bad acts of others DO NOT EXCUSE this bad act. In no moral code, no system of ethics, nor code of justice do two wrongs cancel each other out.

Rob, I read the article and the linked to articles it contained, I still cannot see anything that constitutes a threat, racism yes, threat no.

A quote from the letter: "Just a note from ALL your new neighbors in the new neighborhood. This is a white neighborhood and if you have to choose to live in a white neighborhood ACT white not like niggers. Keep your children contained in your house and not hanging out in the street like gangs. You really hurt the property value of the neighborhood. We so appreciate that." Sounds pretty much like hate to me. And the woman plead guilty to the charges. Stuff it Kyle.

Evidently the woman's own lawyer felt she had made one. If he thought she had not, he would not have advised a guilty plea. You seem to forget that the woman plead guilty - i.e. she admitted to committing whatever the hell she was charged with.

What foolish "reasoning." *Anyone* who knows *anything* about the current workings of the "justice" system knows what a crock this "reasoning" is.
