Interesting shameless British law!

Guys, I was listening to the LBC 97.3 this evening, and i came to know about one piece of legislation in this country that is shameless and stinking. The is apparently called squatter's law/rights, whereby a person could just get into anybody's house, lets say when the residents had gone out for a little shopping for an hour or so, and can claim ownership and live there, and the owners / legal residents there cannot do anything about it, other than to go to court to evict the squatters out the premises!!!! We british always moan about people coming into this country, and we paint them all with the same brush as illegal or stealing jobs fom us, and costing our NHS a lot etc, irrespective of the fact that these lelga immigrants might be ading value to this country and go about minding their own business. Now compare that to squatter rights, and one of the advocate in that program says this is a very usual thing that happens in Britain, and day in and day out this happensm and legal owners will have to spend 10s of thousands of pounds to get the squatters out of the property, via court. I wonder why we have a law that allows British people to let do illegal tresspass into other's houses, and say sorry we can;t do anything about it, please go to court and get them out!!!! Just so you know... if you leave for work in the morning, and when you get back home, you can expect squatters in your home, and not allow you to come in, until you go to court to take them out. From what the advocate said in the program, I believe the squatters break in, and change the lock, and that is it! They can;t be touiched by police or whoever! Shameless British law!!!!! If we let this continue, no one will have any intention to work and earn, they will simply move into other's houses as they wish.

If you are doubting the voracity of the statements regarding the law, rather than the histrionic way it was delivered, then I have to tell you that it is substantially correct. Of course, if you have sufficient, large witnesses to hand who are prepared to swear that the oafs broke in whilst you were inside, eviction is a lot less costly. :-D

not exactly sure where you are getting your information from but its not accurate.. if someone breaks into your house in the UK, then they are breaking the law and can be prosecuted.

Nope! according to the lawyers and court officials who came to the show to confirm what LBC 97.3 said. The lawyer even said there was one case where the squatters broke in, and the owner went to call police, and when the police arrive these squatters said that the house was already broken in by some one else, and they even say a guy running away. Then since this house was open anyway, they came in, and exercised the Squatters rights. The police simply said they could not do anything, and asked the owner to prove that it was the squatters who broke in to the house, and then they will take action, not otherwise. If they are legally using Squatter's rights, they will have to be evicted only by court, and the police walked away.

I am not calling you a liar. However, I find it really hard to believe that this is true...that this can really happen. Granted, I am in the USA and not in England. As far as I know we don't have any laws like that here and I am surprised that you would have laws protecting "Squatters" in England.

As I recall someone can only squat* in an empty (unoccupied) house. *Is it me, or does "squat" seem a ridiculous name?

No, it need not be empty, as long as it is unoccupied, squatters can legally get in and exercise their (stinking) rights! I know you won't agree, but its amazing to know to we British people don;t know our own laws that well! There were many lawyers in teh show who confirmed this to David, and David asked this simple example directly to the guests, and they confirmed.

As someone who works in the Property Industry I can add that this is the law, however there is also no law forbidding a homeowner to re-enter the property and remove them. Just bring a locksmith, and once in, change the locks, they then have no squatters rights, however you may want to bring several of your larger, more muscle-bound friends with you.

Only when sevveral lawyers and squatters themselves came into the show and confirmed to the LBC, i could digest it! Now i can see from where this concept of benefits, free lunch scrounging ideas of British came from. This must have been there for centuries here.

It is known as a HELUVA Problem, (Hostile, Exclusive, Lasting, Uninterrupted, Visible and Actual). That is the basis of Squatters obtaining possession.

As someone who works in the Property Industry I can add that this is the law, however there is also no law forbidding a homeowner to re-enter the property and remove them. Just bring a locksmith, and once in, change the locks, they then have no squatters rights, however you may want to bring several of your larger, more muscle-bound friends with you.

LBC asked this to a policeman (I think) there, and he confirmed that if the squatters won;t allow the owners into the house, if the owners try to enter teh house - then that will be illegal, and squatters can call police and get the owner arrested for infringing the squatters rights. I am sure you won;t accept it, but you and i are not police, and that guy knows his job. "Just bring a locksmith, and once in, change the locks," Nope that cannot be done. Here[^] take a look at the 'What you can and can't do' section. It could happen as code_wiz suggests. As far as damaging the property to gain access part goes the good old 'A big boy did it and ran away' defence often works because as far as the police are concerned it becomes a 'he said, she said' situation. With no certainty of a conviction and the civil law available the police will often opt for the path of least resistance.
