    A couple weeks ago a seller on ebay screwed me over on a phone I bought that was listed as new. original rant.[^] I filed a complaint through ebay's resolution center to try to get my money back. They denied my claim. I appealed their decision and they shot that down too. Basically ebay's argument was that I wasn't entitled to a refund because the word "new" doesn't mean anything. Open up a component, remove some parts, wrap it back up, still new to them. So to all my fellow CP members. If you ever need to sell something on ebay: Mark it as new. Removed components? 10 years old? full of rust? paint falling off? 3yo smashed it with a hammer? All qualifies as brand new to ebay. If you ever get the urge to buy something on ebay: Don't. I'm canceling my account and never dealing with ebay again.

      In real engineering, you do what works in practice, even if the theory says it fails. In social engineering, you do what theory says works, even if it fails in practice.

        I'll most likely be dumping paypal also. I never used paypal for anything outside ebay so it's really of no use to me now.

          I think you'll find that removed parts (but otherwise complete and working) and 10 yrs old (but in as new condition and has not been used) are fine. full of rust is not, paint falling off is not, smashed with a hammer - well, you know it's not. The problem with something like this is that the original item comprised multiple parts (phone, SD card, battery) and the advert apparently said Phone and (presumably) mentioned neither battery or the Sim card. I do rather agree with you that the seller was being dishonest (without seeing the original ad, it's difficult to judge) I have learned by my mistakes (and others) ALWAYS to ask questions of the seller before bidding. if a listing doesn't specifically mention something, I will ask "Are all the original parts included" or "is there anything missing" It's a pain, but safeguards you better.

            I had a hell of a battle to get them to quash a commision charge on a car I never sold (because the highest bidder didnt contact me). After a lot of very insulting emails (me to them) calling them a bunch of fuckwits and a joke, they finally gave in. But they are conning fuckwit bastards with no respect for consumer law.
