I can think of at least 4 laws broken. I thought Texas was tough on criminals?

Breaking a law doesn't necessarily mean you will be arrested. You can also be cited and released or your own recognizance or pending further investigation. This doesn't preclude being arrested at a later date for an offence committed earlier. /ravi

I have lived (I am ashamed to say) in West Virgina. They found a person shot in front of their trailer (where else?) with no weapon of their own, but didn't see an reason to call it a homicide. This following a supermarket that was burned down (for the second time) with solvent cans found in the wreckage - but fire marshal didn't consider these ground to label it arson. The point being is that they have a low crime rate and a high rate of solving crimes - the other things are simply not considered criminal or suspicious and thus neither part of the crime rate or unsolved. TexAss is just West Virgina on steroids (I just made that line up for your reading pleasure)

No shit, but breaking 4 pretty major ones, that lead to a fatality, should lead to charges. You're getting into the specifics of what it means to be arrested, let's just say there were no charges filed. Maybe they are waiting a bit for the guy to mourn before slapping handcuffs on him?

My point is, he can (and probably will) be charged once the investigation is complete. It seems there wasn't sufficient cause to take the individual into custody at the time the police showed up. I'm not suggesting he holds no responsibility. /ravi

The kid was 17 and drinking with his dad, illegal. The guy lied to the police, illegal. The family is in the country, illegally. They can arrest him on any of those while developing more serious charges. Also, since there are no charges, he can freely leave the country, that's why an arrest is important.

Agreed 100%. But the reality of the situation is unfortunately quite different, as I'm given to understand from a close friend who is a member of the Boston PD. Most metro jurisdictions run with a surprising (to the public) low number of resources. Officers are urged to use discretion when deciding whether to place someone under arrest. Prior history, outstanding warrants, threat to public, and severity of offense all contribute to the decision. Which is why you're much more likely to be detained if you commit a crime in a small town (in the US) than a large city. Again, I'm not suggesting the person is not at fault and/or should not be brought to justice. /ravi
