On reflection answering yes to any of those questions it is not unreasonable that it would be worth running something like Malwarebytes on the computer. I guess the abuse is when they start charging for unnecessary work.

Did you read the last paragraph? [Paraphrased]Both companies are now prohibited from lying to customers. So it was okay until they got caught? Microsoft was caught YEARS ago, but all we here from the FTC is crickets.
