    The brazilian law is already similar, but covers not only P2P, it covers anything, so that making unauthorized copies of copyrighted works is a criminal violation AND a civil violation. If the number of copies cannot be determined, it's assumed the number is 3,000 copies. It does not seem to be effective. Brazil is one of the piracy leaders. Thinking twice what will you do, to enforce the law? Send the 2 milion e-mule users to jail? Acting as a substitute for God, he becomes a dispenser of justice. - Alexandre Dumas

        What's the big deal? Although there is legitimate uses for P2P, I'd have to guess that 99% of the usage is illegal transfer of copyrighted material. BW "In a world full of people, only some want to fly,Isn't that crazy?" - Seal

          Yeah, frikkin liberals are all about protecting the lazy-ass, greedy, "entertainers" of our society because most lame "entertainers" are liberal backers. I only support p2p and piracy becuase it shows them how dependent they are on people willing to waste their money on crap entertainment. And isn't the 5 year/$250,00 fine felony already in effect?                 The problem is that it applies to ANY electronic transfer of any copyrighted material without explicit permission of the owner (it covers more than just P2P.) This raises the question of "permission." (On CodeProject, for example, a lot of code doesn't explicitly grant permission to copy the code. If such an author felt slighted, he could conceivably go after people.) I see this as generating a lot of frivilous lawsuits which will ensnare a lot of innocent people. On a more philosophical level, it indicates that nobody wants to seriously debate copyright law itself and its purpose.

A larger issue with law it seems is that too much law (and I'm no lawyer by a long shot) ......, but too much law trys to cover all the bases. Meaning there is less room for judgement by a judge. So anyone doing XYZ gets punishment Q13, regardless of circumstance. maybe I'm wrong, and I certainly can't point to any validation of that right now, but it seems if judges were allowed to judge, then it would be a non-issue.                     I wonder what would happen if someone wrote a virus that distrubted/spammed licensed materials. Who would be liable the virus writer or the owner of the infected machine? andy

                        Currently, as best as I can figure out the law, seems like both. Although, a distributor is not necessarily punished, but they appearantly are under serveillance. A distributor may not be penalized by law, but they can be by their sevice provider in some way. But that's dealing with a private party versus dealing with the government.
