The 1st Amendment restricts what government can do (i.e., they can't make laws that restrict x, y, and z). With all the material leaks of company information happening on sites like finance.yahoo.com, Ragingbull, and FuckedCompany.com I'm not surprised. Gag orders aren't really all that unusual, I've seen them often used simply to clairify that this is an issue covered under an NDA.
