I have rented my house to a family so that I myself can move abroad. They are always late with payment and when I see the man in the house he complains that he has lost his job, broken his arm, got diabetes, hurt his knee, got pneumonia etc. I have been listening and giving him more time to pay but I have caught him lying to me 2-3 times now and decided to remove him from the house. The correct way is to take him to court, but it is not my style. Instead I armed myself sufficiently and asked him to meet me in the garden. He arrived on crutches and very drunk so instead of beating him up I gave him 2 weeks to leave the house. If he leaves in that time I would give him clean papers and no hurt feelings. After 2 weeks I guess I am forced to take him to court if I don't come up with something else. Any advices are welcome jhaga

Give the two week courtesy, then contact the courts. The courts are set up to help protect and enforce your rights. I'm not sure what the laws in your country are, but they could be black and white in terms of what you can and can't do. Arming yourself and looking to beat him up, isn't a good solution, though.

yes, I agree. But taking people to court is a long process in all countries. I need something faster because I am going abroad in one week. jhaga

I cannot speak to laws of your country, but I know a lot about US law. 1. Do you have a contract? 2. If yes, what are the specifications about late payment? 3. Do you have pictures of the state of home when you rented it to him? Many people trash the house when they leave and blame the landlord. 4. In the US, depending on the state, you can type up your own eviction notice and send by certified mail (need to sign to recieve). Once they receive the status, they have a certain amount of days to leave (depending on the state). 5. Any amounts due (rent, deposit amounts that do not cover getting the house to the original condition--which should be done by a third party) should be sought in court. (Called Small Claims Court in the US; usually $5k or less depending on the state.) 6. Some states have a court for eviction; after notice given you can put all items on the lawn. The former tenant can pick them up or anyone else. If you have further questions, see my blog and email me.

thanks leckey, for the only serious reply here 1. Yes, a written standard contract 2. None, but the law gives you right to evict tenants that do not pay in 'reasonable time' 3. Luckily yes. They have two big dogs that has damaged some doors. But most should be possible to fix with some paint. After all, the house is more than 100 year old and has a "rustic" construction. 4. hmm, not possible in my country 5. Good point. I will tell him today that he has to pay for putting the house in original condition also if he does not leave fast. My only real concern is to get him out, the rest doesn't really matter. I need rerent the house so that I can retire(=work less) and move to Brazil. 6. After the court order of eviction, only the police can pull out their items here. Need to check that up, though. jhaga

It is very sad, but the only safe way for you to go is to go directly to the court. If you tell him that you want to make them go, he can prepare himself and even try to look for ways to make it impossible, the best way is to go to the court, prepare everything and then give him some weeks to be ready, but always after having prepared everything. For what you explain they are not in any way serious people and handling this kind of people is always dangerous... Of course, as I said before it is very sad, the nicest thing here would be that the situation would never have come, but now that you are here, it would be very nice if you could speak with them and even solve the situation, being able to get the money in the right time, or agreeing the best date for them to leave, but once again... people are always not predictable...
