We're apparently using different definitions of the word. I mean they have a rep for stepping on the government's toes when defending individual rights.

I think I can get the technicalities they're hinging this on though. They aren't entering your car, they aren't entering any private building, and unless you have a no trespassing sign it's rare to actually get someone on being in your driveway, even less likely on a street or parking lot. I also doubt any existing wire tapping law covers ground vehicles. So they're pretty much claiming the right to do so because no one has said they can't. Technically speaking we have a right against search and seizure, unless we get GPS tracking qualified under search they're pretty much just dropping something on your car and watching where it goes. Legally speaking I'm not sure they can't, as blatant of an abuse as it appears to be.

Didn't all this tracking and invasion of your privacy, tapping your phone, etc etc started with this republican guy, what was his name... oh yeah, George W. Bush?? I think it was called the Patriot Act or something like that... this is what you wanted 8 or 9 years ago, this is what you have... so don't come here complaining about it, I'm pretty sure you were a big supporter of W during his presidency

What's really surprising about that is that it was the 9th Circuit Court of Appeals, which in general has a reputation as being extremely liberal.

The court's ruling, he said, means that people who protect their homes with electric gates, fences and security booths have a large protected zone of privacy around their homes. People who cannot afford such barriers have to put up with the government sneaking around at night." was very telling. A Reagan appointee apparently.

I think it's about time that people stop blaming "the other side" of this issue and realize this is what governments do when the Constitution is no longer recognized. I'll be talking about this on the show. Damned straight.

The dissenting opinion addressed this pretty directly, and accuses the majority of being elitist jackoffs since they can all probably afford to live in gated communities where this couldn't happen, whereas the it's the average Joe whose rights are undermined. It's good stuff; I expect this isn't the last we'll hear on the issue.

This does look like a serious issue, and though it currently only affects eight states, sets a dangerous precedent for the rest. Only solution I see is to get the federal or state legislatures to draft a law to cover this scenario, and make sure that's brought under the umbrella of wiretapping (Or SOMETHING that would require a warrant). The only argument against that is that it's the same as having a police car "tail" you. The difference, though, is that this could be left on and monitored indefinitely for minimal cost, while a "tail" requires an actual use of manpower, so is only done when the police are actively building a case. So, start writing your congressman and senator, CSS... You actually have a valid argument this time. Just try not to curse at them... They tend to ignore that sort of drivel.
