    I've heard of too close races, sometimes just by few votes. This is the first time I read about tie vote. Source[^] If you were the judge, how would you resolve it short of new election? Here is very bad idea <Bad Idea>Allow both to serve with each having half vote. </Bad Idea> ;P :-O

          In New England tradition, this can only be resolved honorably by a duel, pistols at ten paces. The judge may supervise, but not interfere.

                  Judges are typically affiliated with a party, I'm surprised he called this one a tie.

                      Judges are supposed to be impartial and make sure laws are properly interpreted. However, judges are elected officials that usually have a party affiliate. Federal judges are appointed by elected officials, almost always sharing the same political affiliation.
