    I bought a cell phone listed as "new in box" on ebay. By *new* the seller meant that he opened the box, removed sd card containing some of the phones software, switched the original battery for an old one wrapped in tape(seriously), and sent the resulting mess to me. When I contacted him about this BS he claimed that he only said the phone was new. And, since there was no mention that the sd card would be with it that I should not have expected it. :mad: Why has no one invented a technology that will allow me to punch people through the internet? Ebay supposedly has some recourse so people can get their money back. If they can't get my money back on this they are dead to me.

      Take a good look at the advert, and look closely at any pictures. Ebay have a handy description of what the "item condition" descrtipion means: http://pages.ebay.co.uk/help/sell/contextual/condition_1.html[^] It lists two "New" conditions:

      New
      A brand-new, unused, unopened and undamaged item in the original packaging (where packaging is applicable). Packaging should be the same as what is found in the retail shop. If the item comes straight from the manufacturer it may be delivered in non-retail packaging, such as an unprinted box or plastic bag. See the seller's listing for full details.

      New other (see details)
      A new, unused item with absolutely no signs of wear. The item may be missing its original packaging, or the original packaging has been opened or is no longer sealed. The item may be a factory second, or a new and unused item with minor defects. See the seller’s listing for full details and description of any imperfections.

      If the advert header lists either code, then you have a good case against him. Take photos of the kit in the condition it was as it arrived, and keep them to back up your case. You shouldn't have much of a problem, particularly if he used the "new" word in the advert - you would reasonably expect all items to be in perfect condition, and nothing missing that would normally be included unless specifically excluded in the advert.

        Thanks for those. This should be a slam dunk to get my money back. I opened a complaint with Ebay saying he advertised it as new and it wasn't. He replied that "Yeah it's new but I didn't say it would have the sd card." Given that the SD card is included when this thing comes from the factory I don't see how he has a leg to stand on. Kinda like saying, "Sure the car is new, but I didn't say the seats were in it."

          I have had success getting my money back through an eBay/Paypal Dispute in a different but equally annoying situation. It took about 3 months, but was no hassle.

              this is actually a very fine method to make some extra money: claim the package didn't arrive and get back the money from Paypal. My wife had to deal with someone who did this on a regular base. Ebay and Paypal do not care about it (might be different with high priced items). regards Torsten

                this is actually a very fine method to make some extra money: claim the package didn't arrive and get back the money from Paypal.                 Always gotta request delivery confirmation with a signature I guess. Sure they could still dispute it, but at least you would have some proof that it arrived at the address.

                  I had similar reservations. I sold several things on there before I ever bought anything. I always made sure to describe things thoroughly and ship as fast as possible. I had foolishly hoped other people might also take this approach to selling. Swing and a miss. :doh:
