Hello All, I saw on Yahoo that the US Supreme Court will not hear on the ruling about Blackberry. Could anyone fill me in on the details as to what all of this is about, and would any development with Blackberry be unwise due to the ruling? Thanks, Paul

Some crackerjack patent sitter in Canada Virginia is forcing Crackberry (Canada) to go out of business over some unimplemented patent (Crackberry made a success and now crackerjack wants free money.) WASHINGTON, Jan 23 (Reuters) - The U.S. Supreme Court on Monday turned down a request to review a major patent infringement ruling against the maker of the BlackBerry e-mail device. The high court rejected a petition by Research In Motion Ltd. to review a federal appeals court ruling that could lead to a shutdown of most U.S. BlackBerry sales and service. On Oct. 26, Chief Justice John Roberts turned down an earlier request by RIM to stay the lower court's patent infringement ruling while the high court decides whether to hear a RIM appeal. -------------------------------------- WATERLOO, Ontario--(Business Wire)--Jan. 23, 2006-- The U.S. Supreme Court ("Supreme Court") issued an order today in the patent litigation between Research In Motion Limited ("RIM") (NASDAQ:RIMM)(TSX:RIM) and NTP, Inc. ("NTP"). The Supreme Court denied RIM's petition for certiorari that requested the Supreme Court to review issues concerning the extraterritorial reach of U.S. patent law. While review by the Supreme Court is generally uncommon, RIM sought review because it believes the case raises significant national and international issues. Today's order has no bearing on the merits of the outstanding issues in the case before the United States District Court for the Eastern District of Virginia ("District Court"). The District Court will set a hearing date at a later time for further proceedings in the case based on the remand from the U.S. Court of Appeals for the Federal Circuit ("Federal Circuit"). The Federal Circuit decision of August 2, 2005 vacated the injunction and damages award originally entered as a result of the District Court trial in 2002 and remanded the case to the District Court for further proceedings. The Federal Circuit decision also reversed or vacated the infringement finding on 9 of the 16 litigated patent claims. During the upcoming proceedings, the District Court will be asked to decide a variety of matters relating to the litigation, including the impact of the Federal Circuit's reversal of infringement findings on issues of liability and damages. In its briefings, NTP has asked the District Court to enter a new injunction prohibiting RIM from providing BlackBerry service and from using, selling, manufacturing or importing its handhelds and software in the United States. Paul, Thanks for the reply. This sounds along the lines of a thread started about a week ago about lawyers sitting on patents and making money off people who have something "close" but not the same and cry copyright infringement. Does not sound like Blackberry is something to develop on, since it has these legal issues. Paul C.

Too much $$$ involved for too many companies. I wouldn't worry about it too much (i hope..). At the end they'll "make a deal" as they did in the past.
I was wondering if this is something that will just blow by with some deal that makes everyone happy :) Paul C.

The appeals court scaled back the initial ruling, but still concluded that RIM infringed on NTP patents. RIM and NTP had reached a tentative $450 million settlement on the dispute in March, but the deal fell apart in June. RIM wants the lower court to enforce the agreement. NTP has asked the trial judge in U.S. District Court for the Eastern District of Virginia to move ahead with the injunction. It has said an injunction would not affect BlackBerry products used by U.S. federal, state, or local governments. "As a contingency, RIM has also been preparing software workaround designs which it intends to implement if necessary to maintain the operation of BlackBerry services in the United States" -- modified at 12:50 Monday 23rd January, 2006

more that likely.. seems to be the greed game coming into play now, they had a deal (see my next posting) and that was trashed later (abiet RIM's stock price went thru the roof after that announcement....) also, so they shut down the sales in the USA.... "It has said an injunction would not affect BlackBerry products used by U.S. federal, state, or local governments." if i remember, the gov was the biggest users of the device in the states...

Same here. I just wanted to wait until all of this legal situation airs out because I'd hate to get something cool like Blackberry and then have the courts say that I cannot have one because of patent crap. Which ruling? Is it the class action of "People who are annoyed with people who use their Blackberry while you are trying to talk to them vs RIM", or "People who are annoyed with people who pull out their blackberry and start using it in the middle of meetings vs RIM", or "People who just plain can't stand Blackberrys vs RIM"? cheers, Chris Maunder

Chris, I was just curious about what the whole Blackberry issue has been about. A while back I thought of writing software for it and from time to time would see about it in the news. I think all of the threads from this post can give anyone who hasn't heard much about it an idea of what it is about. Paul
