Cisco to sue Apple on iPhone name

In the thread here about the IPhone yesterday I pointed out that Apple was unlikely to ever be able to use the name since Cisco was already using it in business and had the trademark and someone indicated that Cisco and Apple had signed some agreement about this. I guess they hadn't or it fell through.

Never deal with Apple or Steve Jobs. He entered into an agreement with Apple Records (the Beatles music company) to use the name "Apple" for his computer. Apple Records agreed on condition that Apple Computer never enter the music business. And exactly what business is iPod and iTunes in? Cisco should tell Jobs to stuff Apple's iPhone up where the sun doesn't shine.

It's going to be interesting to see if they have to change the name. Possible names: Apple Phone (like Apple TV) Mac Phone Mac Phone X (like Mac OS X) Add your own Apple/Mac derived name to the list... :)

Apple should have called it the iConnect, iCom, iMobile, or iGo. One of their biggest marketing points is that it's not just another phone!

Gee.... who would have seen this coming? Apple is going to lose this case. Cisco owns the trademark and they manufacture a product under it so Apple has not got a hope in hell unless Cisco lets them use it.

Oops. :rolleyes: There's no publicity like, well, Apple's... They'll still make millions off Cisco's trademark*. * Cisco own Linksys, who manufacture and sell the iPhone.

I would not be surprised if Apple will use their size and the fact that 90% of consumers will associate Cisco's mark with Apple, to get away with it. There has got ot be an association rule somewhere in US trademark law.

Apple Records was nice to Apple Computer; they had no clue -- nor did Apple Computer -- how computers would evolve and how we would end up with digital form of music instead of the old analog form. Cisco has no reason to be nice to Steve Jobs. There is no way they will give up their trademark. Cisco is a bigger gorilla than Apple Computer.

Cisco has no reason to be nice to Steve Jobs. There is no way they will give up their trademark. Cisco is a bigger gorilla than Apple Computer.
The deal Apple made with Apple Records many years ago was that Apple could use the Apple trademark for computers but never enter the music industry. But now Apple is most definitely in the music industry (iTunes, iPod etc.) Recently Apple Records got angry with Apple but Apple swatted them aside. They walked all over the trademark deal. Recently, not years ago. Watch them do the same with Cisco.

The Beatles? You're kidding right? On the Monkey Scale (TM) if Apple Inc. is the 400lbs silverback, then Cisco is King Kong and Apple Records is Tarzan's chimp Cheetah! :-D The iPhone BRAND belongs to Cisco, if Apple Inc. wants to use it, they need to play nice with Cisco. The two will likely settle, but right now its just lawyers waving their junk around getting things all wet.

The thing is Apple is probably doing this for the publicity. Forget about the lawsuit, look how much time has been spent talking about this already. Even if they have to change the name now, they have gotten a lot of free publicity for their product. And that is probably worth a lot more than if they lose a lawsuit.
