well, while GWB was governer of Texas he signed 122 death warrants. 25% of those on appeal were found to be completely innocent. 90% of those convicted were black. A bit late to say sorry X| Elaine :rose: Would you like to meet my teddybear ?

Unless you are suggesting that black people are criminals by nature, it would be fairly safe to deduct that: A: There are quite a few racist judges in Texas, and if racism is the cause of the judgement then there has to be a lot of innocent people among the victims. B: There is not equal opportunities for everyone in Texas, and then it might be a better solution to implement this instead of putting the outcome to sleep forever. I remember seeing a programme about this. The point was that if you were black you were 50%* more likely to be given a death sentence than if you were white. So it seemed a little bit biased. * I don't remember the exact statistic, so I made this one up, their all lies anyway Roger Allen Sonork 100.10016 If I had a quote, it would be a very good one.

Of course, as there are no innocents on death row - Judges and Juries are expempt from the clause in human design: "humans make mistakes". I'd bet I, and I am not a laywer, could probably get most of you convicted for the rape of a five year old girl if I used some nice emotive words in my closing speech. :(

"But Ladies and Gentlemen of this supposed jury, I have one final thing I want you to consider. Ladies and Gentlemen, this is Chewbacca. Chewbacca is a Wookiee from the planet Kashyyyk who carried a gun and ran from the mob. But Chewbacca lives on the planet Endor. Now think about it. That does not make sense. Why would a Wookiee, an eight-foot-tall Wookiee, want to live on Endor with a bunch of two-foot-tall Ewoks. That does not make sense. But more important, you have to ask yourself what does this have to do with this case. Nothing. Ladies and Gentlemen, it has nothing to do with this case. It does not make sense. Look at me. I'm a lawyer defending a major record company producer and entertainer and I'm talkin' about Chewbacca. Does that make sense? Ladies and Gentlemen I am not making any sense. None of this makes sense. And so you have to remember when you're in that jury room deliberating and conjugating the Emancipation Proclamation, does it make sense? No. Ladies and Gentlemen of this supposed jury it does not make sense. If Chewbacca lives on Endor you must acquit. I know he seems guilty. But ladies and gentlemen this is Chewbacca. Now think about that for one minute. That does not make sense. Why am I talking about Chewbacca when a man's life is on the line? Why? I'll tell you why. I don't know. It doesn't make sense. If Chewbacca does not make sense you must acquit. Here look at the monkey , look at the silly monkey. The prosecution rests." -- Help me! I'm turning into a grapefruit!

I love Chris Rock's take on the OJ situation. It was something like this:

If O.J. Simpson was a bus driver, he would not have been found not-guilty.
He would have been Orenthal the Bus Driving Murderer.

I agree that money makes a big difference in quality of legal defense, but what would the counteractive measures consist of? Would the government be responsible for providing all lawyers? Or would they just be responsible for paying the fees for whatever attorney you could find? What's to keep a really good defense attorney from saying 'screw this' and taking a high-paying corporate law gig? Or Perhaps we should just expect lawyers to work for free out of the goodness of their hearts! ;P :-D -- Russell Morris "WOW! Chocolate - half price!" - Homer Simpson, while in the land of chocolate.

Nice suggestion, but it could become impactibele, due to furnidhing in the courthouse and bystanders who could get caught in the cross fire. Possibly the criminal could be taken to a sports venue, where a large group of the communit could participate in seeing the state || peoples justice being carried out. Regardz Colin J Davies

Of course, as there are no innocents on death row - Judges and Juries are expempt from the clause in human design: "humans make mistakes". I'd bet I, and I am not a laywer, could probably get most of you convicted for the rape of a five year old girl if I used some nice emotive words in my closing speech. :(

The only choice to make about the death sentence is what is the path that kills the least number of innocent people ? The state will kill innocent people by not deterring killers and by giving them an opportunity to kill again . The state can also kill people by killing someone wrongly accused . Either way the state has responsibility for killing innocent people on our behalf (assuming you live in a democracy) . Therefore the state should minimise this killing , and if that means a few innocent people are hung , then so be it. We do not live in a perfect world and the choice sucks , but burying your head in the sand and pretending that not having the death penalty some how relinquishes the state of blame for the death of innocent people is a denial of responsibility.
