      A work permit cannot be obtained until the person has a job, so finding employment has to come before getting the appropriate visa. This can actually work to the person's benefit, as a large firm will have much more experience navigating the process on behalf of a visa applicant than the applicant himself. Trust me: Kafka was writing about US immigration policy and law. X|

        You have to have a H1B visa, and from what I understand, it's much harder to get those than they used to be. If you want to work as a programmer for a US company, move to India.

            H-1Bs are (in theory) only available for specialities such as engineering, biotech, medicine and other highly skilled "specialty occupations." In addition, the visa holder must have a bachelor's degree or equivalent from an internationally accredited university; mere work experience is not sufficient. A visa holder may only work for the sponsoring company, which must benefit directly from the worker's skills: the sponsor may not be an agency or other placement or work-for-hire outsourcer, and if the visa holder leaves the employ of that sponsor, he must either get a new visa with his new employer or leave the country. Again, all in theory. H-1B is also a "non-immgrant" visa, and visa holders will have a difficult time getting resident status. The visas have gotten much more difficult to get in the last few years mainly because US companies have been abusing the program to Hell and back: there is a glut of cheap immigrant labor that has displaced equally qualified American workers. There was a high profile case about two years ago in Florida, where an insurance company had hired about 40 H-1B workers as unskilled operators taking claims information over the phone. There are other types of work permits, such as the EAD (employment authorization document) issued by the Immigration Service. They have few restrictions, but are designed more for people who either will be staying only a short time (students on work-study programs or non-residents working in the US for a foreign-based company) or as a temporary measure on the path to getting resident alien status (aka a "green card.")                     Yes, it is rather confusing. H-1B does fall under non-immigrant category, but it does not require the applicant to prove intent to leave. Once your Green Card process is underway, and your H-1B has expired, if you've crossed a certain stage in the GC process, you can get an EAD (which is a little better than the H-1B since it lets you switch employers). Trouble with an EAD obtained that way is that it's annual - so you need to renew it every year. And if you ever travel out of the States, you need something called an Advanced Parole to re-enter. Sometimes at airports and other ports of entry, people with EAD/AP have a toughter time than those with stamped Visas. So there are pros and cons.

Right now I am a have a position of Senior .Net developer at Luxoft. If there is anyone, who has moved to the USA...tell me how it was? Was it hard? How did you find your employer? Thanks :)

                        I have worked with Russians in two of the companies I have worked for and basically they all sucked. So, try to be better at coding when you come over here.
