    Heard that phrase on the radio this morning and it occurred to me, if you're insane, how can you plead not guilty using "reason"? Seems rather contradictory to me! ;P

                  The term 'reason', as used in this phrase, does not refer to the ability to reason of either the lawyer or the defendant, but the cause for the defendant of not being guilty (because of not being able to intend to perform a crime due to insanity). Having said that, it would have been clearer to just say 'because' rather than 'by reason of'. :doh: The hilarity simply emerges from the convoluted ways of expressing stuff in legalese.:~

                    Actually something I mull over now and then. For a lot of criminal acts, you's have to be insane to even try them (various reasons). As an example, killing someone for their sneakers. Animal cruelty is another. On that basis, it really is a guilty plea. OK - so we won't send you to prison, but since you're that crazy, we'll never let you out on the streets again. Much to dangerous and unpredictable. Case closed !

                      Always puzzled me how you could be not guilty of murder by reason of insanity - surely no sane person would commit murder?

                                Yep .. it seems to be allowed, and only now I am fully aware of the risk I took ( excluded, banished from the Lounge, not allowed to talk in SOTW, etc ...)
