In exchange, Microsoft will pay for Rowe's expenses, the cost of switching over to a new site, provide training for certification on Microsoft's products, a subscription to Microsoft's developer program Web site, and an Xbox video game console with games, as well as an invitation to bring his parents along for a visit to Microsoft's Redmond, Washington, headquarters for an annual technology fair. Not a bad deal for 17 year old!! Story...[^]

I posted about this previously, when it was first posted about this case. No, maybe they would realize it wasn't MS's website when they click on it. But for someone to have purposefully register a domain name that is phonetically similar to the largest company in the computer industry by a person who's been working on computer for 6 years without thinking he'd get some kind of controversy from it is just idiotic. It's pretty obvious it was a call for attention. His services advertised through his website are not directly linked to devloped/devloping software but instead are supposed to be about web design services (as I read it in the previous article). There was no point for him to have registered his domain as that without realizing the conseqeunces of it when it involves the biggest name in the computer industry. And look at all the fakesites for sites such as Kazaa Lite and Suprnova, the sites that say you can pay for unlimited downloading of pirated software by letting them steal your credit card information. I guess he's lucky his was not one of those sites, or else he would've totally been screwed over.

His name is Mike Rowe, not Mikerowesoft. Either he very well knew that he was poking the giant's ass, then he's an idiot for going "ah look the giant farted at me". Or he didn't knew what he was doing, which makes him a lesser idiot. And, with US trademark law, they barely had another chance than threaten.

The company is required to take action agaist those trying to piggyback of their trademarks, not doing so could lead latter to loosing the trademark. Go read about the Hoover vacum cleaner story - they lost it, by letting the name come to mean vacum cleaning, or as a general term for a vacum cleaner. Google also does this. It does not like people in the press using the term "Google" as an adjective, to mean searching, as it could also loose its trademark, if it was to become a commonly used term for searching, and not their brand name.

I don't doubt that most voice recognition software would pick up "microsoft" before "mikerowesoft", but what about if someone is having a document machine-read to them that contains "mikerowesoft"? How can they tell? Why should they need to? There's a real possibility for confusion.
