Continuing on from yesterday, the guy in question actually hosts hist clients website. He also appears to snoop on their inbox, he intercepted my mail, and posted it to RAC. Apparently, my NDA required that I not make contact with the client. I'm curious now - how is he able to pursue a legal option against me from Canada to Australia ? And how does he have that right, in a world where I can't sue him for using my code without paying for it ? In either case, I have registered www.rentedcoders.com, and I have copied all the arbitrations I've been involved with to my local machine. Expect an anti-RAC site coming from me very soon. Christian I have several lifelong friends that are New Yorkers but I have always gravitated toward the weirdo's. - Richard Stringer

Can you get the phone number of the client and give him a call. If I was the client and new a) what this guy was up to, b) he was reading my e-mail I'd go berserk. Neville Franks, Author of ED for Windows www.getsoft.com and Surfulater www.surfulater.com "Save what you Surf"

Yes, I have a phone number. I've just felt unsure if that would bring the weight of legal action crashing down on me. Otherwise, I'd have done it already :-) Christian I have several lifelong friends that are New Yorkers but I have always gravitated toward the weirdo's. - Richard Stringer

Bah, you could probably sue him for breech (sp?) of contract too. Tim Smith I'm going to patent thought. I have yet to see any prior art.

Does the RAC NDA cover client-to-client communication or only client-buyer? If it does cover the former then don't make any more attempts to contact the other client outside of RAC. Can you send messages through RAC? Anyway: Does Canada not have laws against intercepting mail? In Britian he would be charged with a criminal offence for doing that - intercepting mail, whether through your front door or your computer is a big 'no no' - snooping is a serious enough crime but actually tampering with delivery of mail is a very serious crime. (Canada shares a lot of laws with Britian, no? Let's hope they have this one.) Only the police and certain departments of the crown and government with a warrant issued by a judge can intercept your mail and/or tamper it without your permission. I highly doubt this guy had a warrant or permission so I'd go ahead and ask some qualified people how you can report this to the Canadian police. He has already gone way beyond any hope of having a reasonable discussion with you so you may as well have a little fun with his criminal record. Worst case scenario he might get a warning and his tail between his legs. If you can push he is committing international fraud too then maybe he'd get a trip to the station and his computer equipment seized. It's worth a try. :-D < edit > Has anyone else seen Changing Lanes[^]? :~ </ edit > Christian Graus wrote: Expect an anti-RAC site coming from me very soon. That is an option. If you want to scare the crap out of the guy, have a lawyer in his city or province draft a C&D letter and send a copy to the client. Having someone from Oz do it won't mean anything. :) Tim Smith I'm going to patent thought. I have yet to see any prior art.

I would do anything before talking to a lawyer. You may be able to get a simple consultation with one regarding the problem and only be charged if you pursue the case. If you do seek legal recourse you may screw yourself over by contacting the other party ex parte. Of course, IANAL, but this is what I've heard many, many times. Hmm, just visited the RAC site. Happened to see this: There is a "buyer" on the site who goes by several alias names, including Larry Roberts. Mr. Roberts has encouraged coders to "bend the rules", by going offsite to do large projects for him ($5,000+). Unfortunately for the coders, while they have done many months work of work, none of them have ever been paid. Based on the combined reports from victimized coders, he appears to have gotten at least $100,000 of software development work done absolutely for free.... http://www.rentacoder.com/RentACoder/misc/BidRequests/ShowBidRequest.asp?lngBidRequestId=233052[^] Given your situation and this other story, I wonder how often buyers are taking advantage of the coders. ----------------------------------------------------- Empires Of Steel[^]

Something that just occured to me: given that the buyer had access to the client's e-mail could they be the same person? He might have fake client accounts set up to bid highly on his projects to encourage other high bidders (like yourself) who he knows will do a better job than the $5 bidders, with the eventual aim of screwing the real client over as he has done you? Did this other client bid on your last project (or any other project that wasn't the buyers)? Ok... I promise to stop watching these lunchtime conspiracy documentaties. I blame it on Jessica Fletcher. :) :-O

I had three bad experiences on RAC. One was a real moron who we did work for, I still have the IM logs of my conversations with him at least, and some other stuff stored in emails. The other two are both arbitrations, which show the extent to which RAC make it up as they go, and always to the detriment of coders. I have the transcripts on my HDD, I'll do a site that talks in general about why RAC sucks, why using RAC leaves you open to abuse, reports on the three specific things that happened to me, and a guestbook where people can post their own bad experiences, any that are good enough I'll add to the site overall. I think I can make a site that will both be a clear warning, and also be really funny to read. I'll also do a resume section, just to establish my ability both to code and to work remotely ( i.e. to show that it's not my fault ). Pete who ? I work with Peter Foster, he's the only Pete I know of. I just had a chat with Jim, actually. What made you leave ? Money, I guess ? Bebbington, Would have been a few years ago anyways. I worked with Jim and Mike at Horizion Technologies before it went belly up (well i was there when it went belly up) Came up to Sydney with a few of the guys and stayed. Have since contracted in London for a couple of years and now am off to Durban to work in a couple of weeks. (can any of you saffas tell me what a reasonable salary per month is in SA/Durban?) Tassie is great but yes its not enough money (or at least not enough work at resonable rates), its also a bit small/quiet (thats a plus as wel though). I still think about doing 6 months back down there every now and then. Jim will prolly swear when you say hi from me hehe :P

Hmm... never heard of Horizon Technologies. The quiet is a real plus for me. So long as I have a paid job, I don't care how few there are :-) The money is really poor tho. I will say hi from you, I expect to chat with him this afternoon :P What's the 's' stand for ?
