Using product logo in an advertisement

Hi everyone, We're looking to hire a few developers/graphic designers from our area, and want to place an ad in the local newspaper and local TV station. As we're looking for Macromedia Flash developer, graphic designer, and someone to work with HTML and who knows SCORM quite well, we're thinking of using logos of these products in our ad. The question is, is this legally ok to use a logo of a product or a company in this context? Do I have to ask them for a permission or just need to add a notice like "logos used in this ad are registered trademarks of their owners, Microsoft, etc..."? What are your thoughs? Any lawyers out there? :) Thanks, Rado

Check the EULAs for the related products - many will contain a clause that explains the permitted use of logos, screenshots, trademarks, etc, for advertising and reviews. It certainly wouldn't hurt to contact each of the companies as well to make sure and get something in writing. [edit] I just checked the Macromedia Flash MX 2004 license and it explicitly prevents you from using its logos. Their web site doesn't offer much assistance either.

I know Microsoft has pretty clear-cut terms as to when their logo can be used on your product. You have to get your product certified, then you can put the "Designed for Microsoft Windows" and the Windows logo on your product. Of course, satire is usually a protected form of speech, so if your product is a satire on some other product, you're probably OK too. :-D The generation of random numbers is too important to be left to chance.

Macromedia has a whole section of their site to their logo use and applicable logo displayment. You can also contact them and they will tell you. But if you have to use a logo consider this. If they don't know the words the logo is just eye candy and isn't going to add any value. You can't search a for a logo like you can text. And any logo that should be displayed should be your companies not someone elses company or product. Cheers, -Erik

Thanks for your ideas, I have checked the licensing but also contacted them to make sure I understand it correctly - and it isn't possible to use most of the logos in advertising. So we have dropped the idea. The response from Adobe support was the most confusing I've ever received - they pointed me to the adobe reader download page to read the "how to redistribute adobe reader" instructions. :)

Yes, I guess you're right. After reading the logo licensing and also contacting some of the companies we have decided to drop the idea of using these logos as most of them forbit such use anyway. Thanks for your help. :) Rado
