I'd have thought that the first limitation was when Sony was told that rootkitting all their customers' computers fell outside the realm of copyright protection.

(1) It's technically bogus. You could write "Boo!" on a CD and claim this is your copy protection. (2) It's abused way beyond copyright. (3) Sleazebags tend to have moar lawyers
