    Illegal to disclose .Net benchmarks?!!? From the EULA when installing latest fix: "You may not disclose the results of any benchmark test of the .NET Framework component of the OS Components to any third party without Microsofts prior written approval." :suss: Interesting. I don't read EULA's often.

      This has been quoted often, but there are products on the market that do just that, which I read to mean that this part of the EULA is not enforceable. Sort of like going into a cleaners and seeing a sign stating that the cleaner is not responsible for items that are destroyed. Just because someone states it doesn't necessarily make it enforceable. Note that this is just my opinion. I'm not a lawyer. I just play one on CodeProject.         MS seems not too happy to enforce the EULA either, at least this is what they claim. http://www.infoworld.com/article/02/08/23/020826opgripe_1.html[^] I spoke to Microsoft officials involved in the .Net benchmarking efforts and it's clear they are actually quite frustrated by the situation. They seem sincere in believing that credible benchmarks of current implementations would tell a good story for them. That may well be true (Microsoft has some obvious advantages as the one-stop supplier of all the .Net components), and I told them that I think Microsoft is shooting itself in the foot by bringing the censorship clauses of the database server world into the mainstream of Web services. Their response is that they don't really like the benchmark nondisclosure clause but they had to apply it to Windows 2000 to protect when the other application server vendors adopted censorship clauses. In other words, they need to "prevent disreputable competitors from fabricating bogus tests" as one Microsoft official put it last year.

                Thanks mate. I've been super busy as of late working on a .NET contract and the book with Nish.                     That's the clinical answer, folks. The word from the street is that these days she's strong enough to keep Tom in line and not take any nonsense from him again.
