What's freedom of speech worth if noone is there to listen? And your press can quite easily be shutdown with a barrage of litigations.

It's funny how Americans think theirs is the only country that protects free speech. First of all, many countries protect speech, second of all you have no more free speech than those countries. You are still bound by other laws regarding libel\slander etc, and your 1st amendment only protects you from government curtailing your speech.

In the UK we have a common law "negative right" to free speech. No-one has created a law saying we can't speak freely, ergo we have protected freedom of speech. In addition to those century old rights we also have the more modern Human Rights Act which does explicitly grant freedom of speech, so we have both a "positive right" and a "negative right" to free speech.
