    I guess my point is, it's illegal, but unless you act in such a way that they're likely to catch you, it probably doesn't matter. Gay lovin' ( trying to remember that this is not the soapbox ) is illegal in this state as well, but no-one gets arrested. Why is it illegal ? I'm not sure. But, to me, this is a bit similar. The record companies want to make a point, but the fact is, my MP3 player contains the last 10 or so albums I bought, and there's no way they could ever find that out, so who cares ? Now, if I was to run an FTP server, and they raided me, they may find in my MP3 player some extra charges they could throw at me. Christian Graus - Microsoft MVP - C++

        AFIK--This is an RIAA position, not a legally accepted definition of fair use. Though that may change. The article notes that this is a change even in the RIAAs definition of fair use, and I hope that that inconsistancy bites them in the end. jim

                Actually, it says 'not necessarily'. As far as I can see, the position has not changed since it wasn't legal for me to copy LPs to a cassette for my walkman. The difference, of course, is that every blank tape I bought gave money to the record company anyhow. But then, I used to use the same tapes over and over... Christian Graus - Microsoft MVP - C++

                        I have been saying that all along. I think they have stock in headphone companies and are going to start making everyone listen to music through headphones. Speakers will be outlawed because they are clearly a violation of copyright due to their unlicensed broadcast nature :)

                                        What if I make my own CD eventually, from my own music... do I have to ask permission of myself? Do I have to put it in writing in order to prove I gave myself permission to copy my own music? I am not surprised actually.... disappointed, but not surprised.                                           as i understand it, the basic definition of "fair use" is still pretty much the same as it's always been. so, in that sense, you're 100% correct. but media companies are doing their best to chip away at what we're legally allowed to do with those fair use rights - for one example, we have the right to use small samples of works in our own stuff. but the media companies are trying desperately to make it legally impossible for us to actually obtain those samples by wrapping them in DRM schemes that you can't legally break. it's like being legally able to take a drug that's becoming absolutely illegal to buy, sell or distribute - eventualyl it's not much of a right. and Congress is not on our side.
