As some of the members here may know, I actually work in the mobile phone industry so I'll shed a little light on this for you.

Wrong. All faulty products can be replaced or repaired at the retailers choice and they are not required to do one over the other if it were to be disproportionately costly. Therefore, you will most often be offered a repair as the manufacturer will repair at no cost. They must however do it without unreasonable inconvenience to the customer which is why they will often offer you a courtesy phone. The warranty and the contract of sale are two totally different things and the warranty is not provided by the retailer. Check out the Sale of Goods act for more detailed information.

Correct. Blackberrys are different to any other manufacturer in regard to warranty repair in the UK. The warranty is actually owned by the authorised distributor of the kit. In the case of an Orange blackberry, this is Orange even if you bought it from an independant retailer. The same applies for any other UK network. (If the Blackberry were generic (SIM free) then the warranty would be owned by the supplier (normally 20:20) that the retailer bought it from.) There is no Blackberry warranty repair centre available in the UK to either the trade or public! This leaves the retailer in a very difficult position. You have the right to insist that they get the device repaired (assuming they won't replace) but in the case of a network locked handset the network won't talk to the retailer about the device as it's linked to your account which they can't discuss because of the Data Protection Act! Bottom line, all networks will replace/repair (normally the former) Blackberrys, often the next day, that they have supplied to either you or an independent retailer if you contact them directly. If it's SIM free, the retailer will contact the supplier who will normally do a swap for them. The network/supplier then deal directly with Blackberry. Orange doesn't rock anymore than they did before, they have just fulfilled their obligations under their agreement with Blackberry and unfortunately for 4U (or any other retailer) they are made to look silly by RIM.
